Legal Victory for Impresario Entertainment

The Delhi High Court has officially recognized the restaurant and cafe brand 'SOCIAL' as a well-known trademark. Justice Tejas Karia delivered the verdict on January 9, 2026, granting significant legal protection to Impresario Entertainment and Hospitality Pvt Ltd, the owner of the popular chain.

This landmark decision stems from a trademark infringement suit filed by Impresario against a dessert and beverage outlet operating as 'The Shake Social'. Impresario accused the defendant of infringing its marks, passing off its business as connected to SOCIAL, and diluting its brand value. The company also sought a formal declaration of 'SOCIAL' as a well-known mark.

Brand Recognition Affirmed

The court acknowledged that the 'SOCIAL' brand, in use since 2014, has cultivated distinctiveness and a secondary meaning. This recognition is attributed to its continuous and extensive use across India, substantial investment in marketing, and widespread consumer awareness within the hospitality sector. Impresario operates a dedicated website, 'socialoffline', showcasing its outlets nationwide and making its offerings accessible globally.

Proceedings in the case advanced ex parte, as the defendant, 'The Shake Social', failed to appear in court despite proper service of notice. This meant the court heard only the plaintiff's arguments and evidence.

Impact of the Ruling

Evidence presented highlighted the brand's significant goodwill and reputation. The plaintiff's substantial revenue generation since fiscal year 2014-15 was noted, alongside a considerable promotion expenditure of ₹29,93,18,789 in FY 2023-24. The court found these factors compelling in establishing that the mark 'SOCIAL' had become synonymous with Impresario Entertainment.

Justice Karia concluded that the 'SOCIAL' marks have attained substantial recognition and are widely associated with the hospitality industry among relevant stakeholders. This, coupled with significant marketing investments and consistent visibility, justified its status. The court permanently restrained 'The Shake Social' from using the mark 'SOCIAL' or any deceptively similar variants. Impresario Entertainment was represented by Advocates Shikha Sachdeva, Kriti Rathi, and Annie Jacob.
